1. Agreement to Terms

Welcome to Tutors & Friends. These Terms and Conditions ("Terms") govern your access to and use of the tutoring services, website (tutorsandfriends.com), scheduling tools, and related communications (collectively, the "Services") provided by Tutors & Friends ("we," "us," or "our").

By booking a session, creating an account, making a payment, or otherwise using our Services, you ("you," the "Client," or the "User") agree to be bound by these Terms. If you are entering into these Terms on behalf of a minor (see Section 4), you do so as the minor's parent or legal guardian and agree to be bound on their behalf. If you do not agree to these Terms, please do not use the Services.

2. Definitions

  • "Tutor" means an individual engaged by Tutors & Friends to provide tutoring services.

  • "Session" means a scheduled tutoring appointment, typically conducted live over Zoom.

  • "Client" means the person responsible for booking and paying for Services, who may be an adult student or the parent/guardian of a minor student.

  • "Student" means the individual receiving tutoring, whether or not they are the paying Client.

3. Description of Services

Tutors & Friends provides tutoring for middle school, high school, and college students across a range of academic subjects. Sessions are conducted primarily online via Zoom video conferencing, and in person where available. We may also provide supplementary materials, scheduling tools, progress updates, and session recordings as part of the Services.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We will make reasonable efforts to notify active Clients of material changes that affect ongoing tutoring arrangements.

4. Eligibility and Parental Consent

The Services are intended for use by adults age 18 and older, or by minors with the involvement and consent of a parent or legal guardian.

If the Student is under 18, a parent or legal guardian must book the Services, agree to these Terms, and remain the responsible party for all payments and communications. By doing so, the parent or guardian represents that they have the legal authority to enter into these Terms on the minor's behalf and consents to the minor's participation in Sessions, including any session recordings as described in Section 11.

Parents and guardians are encouraged to remain reasonably available during Sessions and to review our [Privacy Policy] for information about how we handle a minor's personal information in our Privacy Policy.

5. Scheduling and Booking

Sessions are booked through our scheduling system. When you book a Session, you agree to provide accurate information and to attend at the scheduled time. Confirmation and reminder communications may be sent by email and/or text message (see Section 12).

It is the Client's responsibility to ensure the Student has a reliable internet connection, a suitable device, and a quiet environment for the Session.

6. Payment Terms

  • Fees for Services are charged per hour at the following rates:

    • High school and below, on Zoom: $65 per hour

    • High school and below, in person: $75 per hour

    • College, on Zoom: $75 per hour

  • Payment is due on the day of the Session.

  • We accept payment by credit card or debit card.

  • All fees are stated in U.S. dollars and are exclusive of any applicable taxes unless otherwise noted.

  • We reserve the right to change our rates with reasonable advance notice. Rate changes will not affect Sessions already booked and paid for.

7. Cancellation and Rescheduling

We understand that schedules change. To respect our Tutors' time and availability, the following policy applies:

  • Cancellations or rescheduling requests must be made at least 24 hours before a scheduled Session. Requests made within this window will not incur a charge and may be rebooked at no penalty.

  • Cancellations, rescheduling requests, or no-shows occurring less than 24 hours before a Session will be charged the full Session fee.

  • If a Tutor must cancel or reschedule, we will notify you as soon as possible and offer a make-up Session or, where appropriate, a credit or refund.

8. Refunds

  • Prepaid Sessions are refundable if a refund is requested at least 24 hours before the scheduled lesson.

  • Refund requests should be submitted to support@tutorsandfriends.com. For valid requests, the refund will be initiated within 24 hours of the request.

  • Refunds are not provided for Sessions that have already been completed, or for cancellations made less than 24 hours before a Session, except at our discretion where there has been a clear service failure on our part.

9. Client and Student Conduct

To keep Sessions safe, productive, and respectful, Clients and Students agree to:

  • Treat Tutors with courtesy and respect.

  • Refrain from abusive, harassing, discriminatory, threatening, or inappropriate behavior.

  • Not record, redistribute, or publicly share Sessions or Tutor-provided materials without our prior written consent.

  • Not request or pressure a Tutor to complete graded assignments, tests, or other work in a manner that would violate the academic integrity policies of the Student's school or institution.

We support learning, understanding, and skill-building. We do not complete coursework, exams, or assignments on a Student's behalf. We reserve the right to refuse or terminate Services for any conduct that violates these standards.

10. Academic Outcomes — No Guarantee

Tutoring is a supportive service that depends heavily on each Student's effort, engagement, and circumstances. While our Tutors work hard to help Students improve, we do not guarantee any specific academic result, including particular grades, test scores, admissions outcomes, or pass/fail results. Nothing in our marketing, communications, or these Terms should be interpreted as a promise of a specific outcome.

11. Session Recordings

Some Sessions may be recorded for quality, training, review, or to provide the recording to the Client as a study aid. By participating in a Session, the Client and Student consent to such recording. For minors, the parent or guardian provides this consent under Section 4.

If you do not wish for a Session to be recorded, please notify your Tutor or contact us in advance. We will handle recordings in accordance with our Privacy Policy.

12. Communications and Text Messaging

By providing your phone number, you consent to receive Service-related communications from us, which may include appointment confirmations, reminders, scheduling updates, and account messages, delivered by email and/or SMS text message. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, or contact us to update your communication preferences. Opting out of certain messages may affect our ability to deliver scheduling reminders.

13. Intellectual Property

All content we create and provide — including worksheets, study guides, lesson materials, and website content — is the property of Tutors & Friends or its licensors and is protected by applicable intellectual property laws. You may use these materials for the Student's personal, non-commercial educational use only. You may not reproduce, distribute, resell, or publicly post our materials without our prior written permission.

14. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information, including information about minors. Please review it carefully.

15. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of technical issues, including those arising from third-party platforms such as Zoom or internet connectivity problems outside our control.

16. Limitation of Liability

To the fullest extent permitted by law, Tutors & Friends, its owners, employees, and Tutors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or relating to your use of the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services shall not exceed the total amount you paid to us for the Services giving rise to the claim during the three (3) months preceding the event that gave rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Tutors & Friends and its owners, employees, and Tutors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Services.

18. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or that we reasonably believe is harmful to our Tutors, other Clients, or our business. You may stop using the Services at any time. Any outstanding balances remain due upon termination.

19. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

20. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated to active Clients where reasonable. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

Tutors & Friends SMS Terms and Conditions

These Terms and Conditions govern SMS communications provided by Tutors & Friends.

Program Description

Tutors & Friends sends conversational and operational text messages related to tutoring services, including:

  • Appointment reminders

  • Scheduling updates

  • Tutor coordination

  • Academic support communications

  • Lesson preparation information

  • Service related notifications

Message Frequency

Message frequency varies depending on tutoring schedules and service activity.

Message and Data Rates

Message and data rates may apply depending on your mobile carrier plan.

Opt In

Users opt in to receive SMS communications by explicitly checking a consent checkbox on the Tutors & Friends appointment booking page, hosted on Acuity Scheduling. The checkbox states: "By checking this box, you consent to receive SMS communications from Tutors & Friends about your appointments, scheduling, and tutoring services. Message and data rates may apply. Message frequency varies. Reply HELP for help or STOP to opt out."

No SMS messages are sent to any customer who has not affirmatively checked this box.

Opt Out

You may opt out at any time by replying STOP to any SMS message.

After opting out, you will no longer receive SMS communications except for legally required notifications.

Supported Carriers

Message delivery is subject to your mobile carrier’s availability and reliability.
